Terms of Service

These Terms of Service ("Terms") govern your use of MyPhoneGenie, operated by Phone Genie LLC ("we," "us," or "our"). By creating an account or using our services, you agree to these Terms.
1. Service Description
MyPhoneGenie provides AI-powered phone answering and chat widget services for businesses. Our platform scans your website to build a custom knowledge base, then deploys an AI receptionist that handles phone calls and website chat inquiries on your behalf, 24 hours a day, 7 days a week. Services include:
- AI Chat Agent: An intelligent chat widget embedded on your website that answers customer questions using your knowledge base.
- AI Phone Agent: An AI receptionist that answers calls to your dedicated business number, handles inquiries, and captures caller information.
- AI SMS Agent: Automated text message handling with workflow-aware responses.
2. Account Terms
- You must be at least 18 years of age to create an account.
- Accounts are for business use. MyPhoneGenie is a B2B service.
- You must provide accurate and complete information during registration and keep it up to date.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- One person or business entity per account. Multiple locations are supported within a single account based on your plan tier.
3. Free Trial
No credit card required for your free trial. No payment information is collected until you choose to activate your account.
- New accounts receive a 7-day free trial with 15 voice minutes included. No payment required.
- One free trial per business (identified by website domain).
- The trial ends after 7 days or when 15 minutes are used, whichever comes first.
- When the trial ends, your account pauses. There is no automatic charge.
- To continue service, prepay for your chosen plan via PayPal or other accepted payment methods.
- Unused trial minutes carry over to your paid plan upon activation.

4. Billing & Subscriptions
- Paid plans are billed monthly on the anniversary of your activation date.
- Each voice plan includes a set number of voice minutes per month. Minutes exceeding the plan allowance are billed at the overage rate for your tier:
- PhoneGenie: 100 minutes included, $0.75/min overage
- PhoneGenie Pro: 300 minutes included, $0.50/min overage
- Enterprise: 750 minutes included, $0.35/min overage
- Phone number fees ($1.15/month per number) are billed in addition to your plan subscription.
- All prices are in US dollars.
- We reserve the right to adjust pricing with 30 days written notice. Existing subscribers are locked into their rate for the current billing period.
5. Refund Policy
We offer a 30-day money-back guarantee on all paid plans. Refunds are prorated based on unused voice minutes.
Example: You are on a plan with 100 minutes and have used 40 minutes. You would receive a 60% refund (for the 60 unused minutes).
- Refund requests must be made within 30 days of your first paid billing date.
- Refunds are processed within 5–7 business days to your original payment method.
- Phone number provisioning fees ($1.15/month) are non-refundable once a number has been provisioned.
- No refunds are issued after the 30-day window.

6. Acceptable Use
You agree not to use MyPhoneGenie to:
- Send spam, unsolicited messages, or bulk automated calls.
- Engage in any illegal, fraudulent, or deceptive activity.
- Impersonate any person or entity, or misrepresent your affiliation.
- Abuse, harass, or threaten others through the platform.
- Attempt to reverse-engineer, exploit, or compromise our systems.
- Use the service to collect sensitive data (SSN, credit card numbers) via AI conversations without proper compliance frameworks in place.
- Scrape or build knowledge bases from websites you do not own or have permission to represent.
- Resell or redistribute the service without a written reseller agreement.
Violation of these terms may result in immediate account suspension or termination without refund.
7. Call Recording & Disclosure
Calls handled by MyPhoneGenie AI agents may be recorded for quality assurance and service improvement. An automated disclosure is played at the beginning of each call to notify the caller that the call may be recorded.
- Call recordings are stored securely and automatically deleted after 90 days.
- You are responsible for ensuring that call recording complies with applicable laws in your jurisdiction, including two-party consent states.
- Transcripts of calls are available in your dashboard.
8. AI Disclaimer
MyPhoneGenie uses artificial intelligence. AI responses may occasionally be inaccurate, incomplete, or inappropriate. The service is not a substitute for professional advice (legal, medical, financial, or otherwise).
- We make continuous efforts to improve AI accuracy but cannot guarantee error-free responses.
- You are responsible for reviewing and verifying the accuracy of information your AI agent provides to callers.
- AI agents respond based on the knowledge base you provide. Keeping your knowledge base accurate and up to date is your responsibility.
- The Service does not replace human judgment, professional expertise, or regulatory compliance obligations.
9. Healthcare Clients
If you are a healthcare provider or medical practice:
- The AI agent does not provide medical advice, diagnoses, or treatment recommendations.
- Do not configure your knowledge base to include protected health information (PHI) unless a Business Associate Agreement (BAA) is in place.
- A BAA is available for clients on the Enterprise plan. Contact support@myphonegenie.com to arrange one.
- The Service is designed for general office inquiries (hours, locations, insurance accepted, appointment scheduling) -- not clinical consultations.
- You remain responsible for all compliance obligations under HIPAA, state medical board regulations, and other applicable healthcare laws.
10. Service Availability
We use commercially reasonable efforts to maintain high availability of our services. However, we do not guarantee 100% uptime. The service may experience downtime for:
- Planned maintenance (we will attempt to provide advance notice)
- Third-party outages (Twilio, Telnyx, Google, Azure)
- Force majeure events
11. Intellectual Property
- Your content: You retain ownership of your business content, knowledge base data, and call recordings. You grant us a limited license to use your content solely to provide the services you have subscribed to.
- Our platform: MyPhoneGenie, its code, design, AI models, and underlying technology are the property of Phone Genie LLC. Your subscription grants you a limited, non-exclusive, non-transferable right to use the platform.
12. Limitation of Liability
To the maximum extent permitted by law, Phone Genie LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, profits, business opportunities, or data, arising from your use of or inability to use the service.
Our total liability for any claims arising under these Terms shall not exceed the total amount you paid to us in the 12 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
13. Indemnification
You agree to indemnify, defend, and hold harmless Phone Genie LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:
- Your use of the Service
- Content in your knowledge base
- Your violation of these Terms
- Your violation of any applicable law or regulation
14. Termination
- By you: You may cancel your subscription at any time through your dashboard or by emailing support@myphonegenie.com. Cancellation takes effect at the end of your current billing period.
- By us: We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with 30 days notice (or immediately for Terms violations).
- After termination: Your data (knowledge base, recordings, transcripts) will be retained for 30 days, during which you may request an export. After 30 days, all data is permanently deleted.
- Phone numbers assigned to your account will be released 30 days after termination.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Clark County, Nevada.
16. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. For material changes, we will notify active account holders by email at least 30 days in advance. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
